नौहट्टा में पथराव से पसरा सन्नाटा

श्रीनगर (31 अगस्त)। ईद-उल-फितर की तैयारियों में मंगलवार को बेशक पूरी घाटी व्यस्त थी, लेकिन डाउन-टाउन के नौहट्टा और उससे सटे इलाकों में सुबह पथराव हुआ और फिर सन्नाटा पसरा रहा। इसे प्रदर्शनकारियों की नारेबाजी ही बीच में कई बार भंग करती नजर आई। नौहट्टा में प्रदर्शन करने वालों में नौजवानों के बजाय अधेड़ उम्र के पुरुष और स्थानीय महिलाएं ही सबसे ज्यादा थीं। महिलाएं हाथों में डंडे लिए वहां से गुजरने वाले वाहनों को भी रोकती नजर आई। बड़ी संख्या में स्थानीय लोगों ने थाने में भी दाखिल होने का प्रयास किया, लेकिन पुलिसकर्मियों ने उन्हें इसकी अनुमति नहीं दी। लोग रविवार सुबह पुलिस द्वारा हिरासत में लिए गए युवकों की रिहाई की मांग कर रहे थे। गौरतलब है कि शनिवार देर रात को नौहट्टा पुलिस स्टेशन पर हमला करने और हिंसक झड़पों में शामिल होने वाले 73 लड़कों को पुलिस ने हिरासत में लिया था। इनमें से 40 लड़कों को पुलिस ने रिहा कर दिया, जबकि अन्य को अदालत ने गत सोमवार को 15 दिन के ज्यूडिशियल रिमांड पर भेज दिया था। ज्यूडिशियल रिमांड पर भेजे गए युवकों की रिहाई के लिए लोग प्रदर्शन कर रहे थे।

SRINAGAR, Aug 29: Police has started to release youth who have been booked for throwing stones and in the first phase around 50 youth have been released. More youth are expected to be released tomorrow, but after proper scrutiny.

“The release of the arrested youth has been started after the chief minister Omar Abdullah announced the same,” Director General of Police (DGP) Kuldeep Khoda told Kashmir Times over phone. “Some youth have been released and more will be released in day or two. The cases against them are being withdrawn,” he added.

The police chief said that the youth who are involved in arson would not be released or left. “The youth who are involved in arson would not be released and every district SSP is following the announcement in letter and spirit,” Khoda added.

In Srinagar, police has released around 50 youth who were lodged in different jails for throwing stones. Senior Superintendent of Police (SSP) Srinagar Syed Ashiq Hussain Bukhari told KTNS that around 50 youth were released. “We have released around 50 among the arrested lot,” he said. “The others will be released after proper scrutiny. We are examining the cases against them,” he added.

The SSP said that their release depends on their involvement. “We will look into their cases at a fast pace because of Eid-ul-Fitr,” Bukhari added.

A middle rung police officer told KTNS that north division of police in the city will decide in the evening about the release of more youth. “Today evening cases of youth arrested for stone throwing would be scrutinised,” he said and refused to divulge further details.

However, police has not released the seven youth who were arrested on Sunday in Anantnag district of south Kashmir. Top sources in police said that once they (seven youth) get bail, there is possibility of their release. “They are involved in fresh cases of stone throwing and did not fall in amnesty announcement category,” a senior police officer from Anantnag told KTNS.

Meanwhile, the security arrangements for Eid were also finalised today at high level meeting chaired by Inspector General of Police (IGP) Kashmir S M Sahai. The security arrangements for Eid were discussed in length.

During the meeting, according to police sources, it was decided that police and CRPF troopers would be deployed heavily at all volatile places across the valley to foil any attempt of disruption of peace.

“We did not clamp curfew last year despite high running tension and there is no chance of curfew on this Eid. But there will be heavy security arrangement in place,” a senior police officer who attended the meeting told KTNS on the basis of anonymity. “Police would not take any risk,” he added.

The meeting was attended by IG and DIGs of CRPF, and SSP of all volatile districts of valley. DIG north Kashmir, DIG Srinagar, SSP Srinagar, SSP Baramulla and SP Sopore were present during the meeting.

पत्थरबाजों को माफी देने पर भड़के बजरंगी

जम्मू। मुख्यमंत्री उमर अब्दुल्ला द्वारा पत्थरबाजों को माफी देने के एलान के बाद कई संगठन अब राज्य सरकार के विरोध में उतरने लगे हैं। सोमवार को बजरंग दल जम्मू-कश्मीर इकाई ने न्यू प्लाट में प्रदर्शन कर सरकार का पुतला जलाया। कार्यकर्ताओं का कहना था कि मुख्यमंत्री देशविरोधी गतिविधियों में लिप्त लोगों को बचाने का प्रयास न करें। 

प्रदर्शन की अध्यक्षता संयोजक राकेश शर्मा ने की। उन्होंने कहा कि बाबा अमरनाथ भूमि आंदोलन के दौरान करीब 190 राष्ट्र भक्तों पर दर्ज हुए मामले आज भी चल रहे हैं। सरकार को इन राष्ट्र भक्त युवाओं की कोई चिंता नहीं है बल्कि फसाद बढ़ाने वाले पत्थरबाजों की चिंता है। बजरंग दल ने चेतावनी दी कि सरकार ऐसा कोई कदम न उठाए जिससे राष्ट्र विरोधी लोगों को बल मिले।

पत्थरबाजों की आम माफी को सही कदम मान रहा केंद्र

नई दिल्ली। जम्मू-कश्मीर सरकार की ओर से घाटी के पत्थरबाजों की आम माफी के कदम को केंद्र ने राज्य के लिए अनुकूल माना है। केंद्र का मानना है कि ऐसे कदमों का तुरंत असर नहीं दिखेगा, लेकिन दीर्घकालिक लाभ जरूर मिलेगा। गृह मंत्रालय के वरिष्ठ सूत्रों के मुताबिक केंद्र का मानना है कि कश्मीर में आम लोगों में विश्वास बहाली की दिशा में उठाए जाने वाले कदमों के लिहाज से यह अहम फैसला है। इससे खासकर कुछ भटके हुए युवाओं का शासन के प्रति गुस्सा कम होगा। मालूम हो कि राज्य सरकार के इस एलान के अगले ही दिन कुछ पत्थरबाजों ने फिर से पुलिस को अपना निशाना बनाया। लेकिन केंद्र का मानना है कि पुलिस पत्थरबाजों से निपटने के लिए स्वतंत्र है। राज्य सरकार ने भले ही आम माफी दी हो, लेकिन उनके खिलाफ कार्रवाई के लिए रोक नहीं लगाई है।

मुफ्ती के इफ्तार से दूर रहे मीरवाइज व गिलानी

श्रीनगर। पीपुल्स डेमोक्रेटिक पार्टी के संरक्षक व पूर्व मुख्यमंत्री मुफ्ती मोहम्मद सईद ने सोमवार का इफ्तार का आयोजन किया। उन्होंने इसमें अलगाववादी खेमे के सभी प्रमुख नेताओं को दावत दी, लेकिन कोई नहीं आया। सूत्रों की मानें तो पूर्व मुख्यमंत्री मुफ्ती मोहम्मद सईद ने रोजा-ए-इफ्तार की दावत में हुर्रियत के कट्टरपंथी गुट के चेयरमैन सैयद अली शाह गिलानी, उदारवादी गुट के प्रमुख मीरवाइज मौलवी उमर फारूक, बिलाल गनी लोन सरीखे नेताओं को बुलाया था। अलबत्ता, एक भी अलगाववादी नेता रोजा खोलने के लिए मुफ्ती साहब की इफ्तार पार्टी में शामिल नहीं हुआ।

मीरवाइज मौलवी उमर फारूक ने भी दावत के न्यौते की पुष्टि की और गिलानी के प्रवक्ता ने भी बताया कि उन्हें मुफ्ती मोहम्मद सईद ने न्यौता भेजा था। इन दोंनों ने दावत में शरीक न होने के कोई स्पष्ट कारण नहीं बताए। हालांकि, मुफ्ती मोहम्मद सईद ने सत्तासीन गठबंधन में शामिल कांग्रेस के प्रदेश प्रमुख सैफुदीन सोज, मुजफ्फर अहमद पर्रे और गुलाम नबी मोंगा को भी दावत में बुलाया था, लेकिन पीडीपी ने नेकां के किसी भी नेता को नहीं बुलाया। देर रात गए इस खबर के लिखे जाने तक कोई भी अलगाववादी नेता मुफ्ती की इफ्तार पार्टी में नजर नहीं आया।

जैश कमांडर समेत दो आतंकी ढेर

श्रीनगर। सुरक्षाबलों ने दक्षिण कश्मीर के पुलवामा जिले में सोमवार को एक मुठभेड़ में जैश-ए-मोहम्मद के जिला कमांडर इकरम भाई को उसके स्थानीय अंगरक्षक समेत मार गिराया। एसपी पुलवामा अमित कुमार ने बताया कि मत्रगाम में दोपहर बाद आतंकियों का एक दल अपने एक संपर्क सूत्र के पास आया। स्थानीय लोगों ने इसकी सूचना निकटवर्ती चौकी को दी। उसके बार 53 और 55 आरआर के जवानों के साथ मिलकर पुलिसकर्मियों ने अभियान चलाया। जवानों ने आतंकियों को आत्मसमर्पण करने के लिए भी कहा, लेकिन उन्होंने इससे इंकार कर दिया। उसके बाद वहां मुठभेड़ शुरू हो गई। करीब चार घंटे की मुठभेड़ में मकान में छिपे दोनों आतंकी मारे गए। इनमें से एक पाकिस्तान का रहने वाले इकरम भाई है। वह जैश का जिला कमांडर था। दूसरे की पहचान फारूक अहमद लोन के रूप में हुई है। वह खंडीपोरा पखरपोरा, पुलवामा का रहने वाला था। एसपी ने बताया कि मुठभेड़स्थल की घेराबंदी जारी है।

पंडितों की वापसी पर तीन को अपेक्स करेगी मंथन

श्रीनगर। विस्थापित कश्मीरी पंडितों की वादी वापसी की औपचारिकताओं को तय करने के लिए राज्य सरकार द्वारा गठित अपेक्स कमेटी की बैठक शनिवार तीन सितंबर को जम्मू में होने जा रही है। राहत, पुनर्वास एवं राजस्व मंत्री रमण भल्ला की अध्यक्षता में गठित 40 सदस्यीय अपेक्स कमेटी प्रधानमंत्री द्वारा कश्मीरी पंडितों की वापसी और पुनर्वास के लिए जारी किए गए 1618 करोड़ रुपये के पैकेज के तहत जारी विभिन्न कार्य योजनाओं का भी जायजा लेगी। भल्ला ने इसकी पुष्टि करते हुए बताया कि हालात अनुकूल रहने पर बैठक शनिवार को जम्मू में होगी। इसमें हम कश्मीरी विस्थापितों की वादी में सुरक्षा व आवासीय सुविधा के अलावा उन्हें वापसी के लिए कैसे मनाया जाए, इस पर भी बात होगी। कश्मीरी पंडितों की वापसी हमारी प्राथमिकताओं में है। 

अपेक्स कमेटी के उपाध्यक्ष व गृह राज्यमंत्री नासिर असलम वानी ने बताया कि मैं खुद इसमें शामिल होने के लिए जम्मू जा रहा हूं। बैठक में कश्मीरी मुस्लिमों, कश्मीरी पंडितों और सिख समुदाय के प्रतिनिधि भी हिस्सा लेंगे। बैठक में कश्मीरी पंडितों की कश्मीर वापसी की सभी औपचारिकताओं को तय किया जाएगा। कश्मीरी पंडित कश्मीर का अभिन्न हिस्सा हैं, उनके बिना कश्मीर अधूरा है। राहत एवं पुनर्वास आयुक्त विनोद कौल ने सरकार द्वारा उठाए जा रहे कदमों की जानकारी देते हुए कहा कि प्रधानमंत्री द्वारा कश्मीरी पंडित विस्थापितों की वापसी के लिए जारी रोजगार पैकेज के तहत 1400 पंडितों को कश्मीर में नौकरी दी गई है। हालांकि, आज तक कोई भी पूरा परिवार वापस कश्मीर नहीं लौटा है। यह भी शनिवार की प्रस्तावित बैठक के एजेंडे में शामिल है। (दैनिक जागरण, 30 अगस्त 2011)

Formal order needed for CM’s amnesty to youth

SRINAGAR, Aug 28 : While chief minister today announced general amnesty for the stone-pelters, except those involved in arson, legal experts here argue that until and unless a formal order in this regard is issued, cases against the youth cannot be withdrawn. “There are more than 20 percent youth who have been  charged with attempt to murder after being arrested for stone pelting. Many cases are under trial and many are still under investigation. So a formal order mentioning the guidelines to be applied to different kinds of cases registered against youth should come from the government. Mere announcement will not  do,” said a prosecuting officer wishing anonymity.

He said that the chief minister seems to be unaware of the fact that at least 20 percent youth  arrested for stone pelting are also facing trial under the offences like attempt to murder. “CM has only mentioned about one offence but the attempt to murder a soldier is more serious offence legally than the former, about which there is no mention in CM’s announcennment,” said another legal expert, not wishing to be named. He said that the withdrawal of cases against the youth will involve a legal process for which a formal order with the proper guidelines applicable on different kinds of offences needs to be issued.

Policy for ‘stone pelters’ arrested in 2010 summer

SRINAGAR, Aug 28: In a significant development the state government today announced withdrawal of cases against around 1200 youths charged with stone pelting last summer. However, the not-to-be-repeated ‘general amnesty’, evades nearly 100 others charged with arson and damage to property and all those who are still absconding.

“We have decided to withdraw charges against all youths who were arrested on charges of stone pelting last year except the ones involved in arson or damage to property. The amnesty, however, does not include those still in hiding,” chief minister, Omar Abdullah, told reporters in a press conference at Sher-e-Kashmir International Convocation Centre (SKICC).

“The cut-off date for amnesty is today....,” he added. “In future the arrestees can only be granted bail, but this ‘general amnesty’ will not be repeated.” The number of those charged with arson and damage to property is less than 100, Omar revealed later in response to a question.

The government decision has come days ahead of the Eid-ul-Fitr, the deadline set by separatist leader, Syed Ali Shah Geelani, for government to release last year’s prisoners. The octogenarian separatist intended to launch an agitation after Eid if his demands, including the release of prisoners, were not fulfilled.

The separatist’s intentions met with a strong criticism from the state government, but the latter refused to budge from his stand.   Recently, the government also announced the release of 12 separatist leaders.

Without linking it to Geelani’s threat, the CM said the amnesty was government’s “Eidi (Eid gift)” to youth, granted for an end to “apprehensions in the society.”

“We do not want to play with your future like they (separatists) did,” CM said, addressing the youth. “Please see that they used you last year and then left you onto your own. Now they demand the release of their companions, but no one talks about you.”

Responding to a question, the CM said the amnesty was purely a decision of the state government “without having anything to do with the interlocutors’ recommendations.”

“I would assume that it is their (interlocutors) area of interest, but we have not received any recommendations on this case from interlocutors,” he said.

There are 35 persons detained under Public Safety Act (PSA) and 70 others are in judicial custody, Omar said, giving details, adding that as many as 76 government buildings were set afire, while 38 others were damaged.

“Sixteen private buildings were also set ablaze, while 18 others were damaged,” he said. “Sixty two vehicles, including 37 owned by the government, were burnt down while 160 other vehicles were damaged during protests.”

Govt waiting for final SHRC report

The chief minister said the government would wait for the final report on mass graves from state human rights commission before suggesting or announcing any future course of action.

“SHRC has asked for our response after which it will prepare its final report. We are waiting for the final report and once it comes we will suggest or announce the future course of action,” he said.

Separatist agenda directed from across

Responding to a query about the Mirwaiz Umar Farooq stand against exploitation of state’s water resources, Omar said the “separatists’ agenda is directed from across the Line of Control (LoC).” He said the Pakistan wanted to delay the Kishenganga project “and when it could not be achieved legally they are attempting to do it the other way.

70 stone pelters arrested during night long clashes

SRINAGAR, Aug 28: In a major crackdown against stone pelters, police today arrested 70 of them while they clashed with police in Nowhatta area of Srinagar's old city during last night as people were observing the Shab-e-Qadr across Kashmir valley.

Today's arrests of stone pelters are largest in a single day in the recent years. Police said that over 300 motorcycle-borne stone pelters attacked Nowhatta police station injuring six policemen. Over 70 attackers were arrested and 10 bikes were seized during the clashes, which lasted for five hours, police said. However, residents claimed some of them are not stone pelters but they were observing Shab-e-Qadr and were picked up after night long attacks on police. People in Masjids across the Kashmir valley were busy in night long prayers to observe Shab-e-Qadr, the holiest night for Muslims. One of the biggest congregations was at Jamia Masjid Srinagar and outside it the stones pelters attacked the police.

Police and security forces were busy facilitating the smooth conduct of prayers at various masjids in the city, immediately rushed to the spot and ding dong battles continued for whole night. Police said that the stone pelters also tossed two petrol bombs on police. Six policemen were injured, two of them seriously. Police said the stone pelters have of late been using motorcycles to throw stones at security forces and fled away quickly.

"The typical practice is that such bikes carry three people, one rides the bike, the man in the middle has stones in his lap and the one at the back hurls them at the security forces. And they move at a menacing speed," police said.

The police station Nowhatta was the main target of the stone pelters in last years summer agitation. The station was attacked several times by the stone throwing youth.

CM announces amnesty for youth arrested during summer agitations

SRINAGAR, Aug 28: Chief Minister Omar Abdullah today announced an amnesty package for the youth arrested during last years summer agitation in Kashmir valley.

While addressing a press conference this afternoon, Omar said that the amnesty is for all those booked on charges of stone pelting, except for those involved in cases of arson during the agitation.

Terming this as an Eid gift, he said youth should grab this opportunity. "This would be first and last chance for them as we are not going to tolerate their actions in future", he added.

The amnesty has been extended to the youth who have gone into hiding after being released on bail provided they come forward and present themselves before the law enforcing agencies. He asked parents of these youth to come forward and play their role.

The Chief Minister said that these youth were misguided by certain vested interests who are not concerned about them now.

He said the decision to withdraw cases against the youth was taken to ensure their better future. "The cases of youth involved in arson would be reviewed if the situation remained normal and no unfortunate incidents are reported," he asserted.

Mr Abdullah said that the future of these youth is at stake and their career has been marred. "They cannot get jobs and passports since No Objection Certificate (NOC) would not be released in their favour. As such we have decided to give them a chance and their record would be set straight."

While giving details about the youth arrested during last years agitation, the Chief Minister said that during past 16 months cases were registered against 1300 persons adding 35 stone pelters are serving detention under PSA. "As of now 70 youth are in judicial remand. The number of youth booked in cases of arson is in double digits and it is definitely below 100."

Omar said, the issue of arrests has been blown out of proportions by certain quarters. "Some people say thousands of youth are languishing in jails and thousands have been booked under Public Safety Act (PSA). This is a blatant lie and I vehemently deny these accusations," he added.

While taking a dig at the separatists that last year's agitation was peaceful, he said arsonists damaged buildings, vehicles and other public utilities. Seventy six Government buildings were gutted completely while as damages were caused to 38 others.

"Sixteen private buildings were gutted completely while as 18 others suffered damages. Thirty seven Government vehicles were burnt while as 75 others suffered damages. In the same way 75 private vehicles were burnt and 85 others suffered damages," Mr Abdullah said.

The Chief Minister said some people tried to vitiate the peaceful atmosphere this year also by playing with the emotions of people. He complimented the masses for maintaining law and order in the State adding that they ensured peace despite some unfortunate incidents.

Meanwhile, while announcing the devolution of powers to Panchayats, Omar said the Panchayats would become fully functional from September 1.

He said that Panches and Sarpanches would be empowered to take decisions on various developmental issues and administrative matters. "Untied grants to the tune of Rs 1 lakh would be allocated to each Panchayat halqa for taking up emergent works."

The Chief Minister said some politicians wanted to create confusion among the ranks of Panches and Sarpanches saying that Government is not committed to the transfer of powers.

"This is the first installment of powers to the Panchayats and more powers would follow with the passage of time. We had promised to empower Panchayats before Eid and today we have done our bit. Now the onus lies on Panches and Sarpanches and they should discharge their duties with honesty and sincerity," said Omar Abdullah.

He said the Panchayats would prepare plans for the development of the halqa, undertake measures for the implementation of the development plan and deal with problems of soil conservation, water management, social forestry, rural industrialization, agriculture, sheep and animal husbandry, sanitation, health and other welfare programmes.

"It would be the responsibility of Panchayats to maintain, operate and supervise primary schools, medical sub-centres, Panchayat Bhawan, roads, lanes, drains, culverts, sheep extension centres, veterinary extension centres, Zamindar khuls, anganwari centres, training centres of Social Welfare and Handicrafts Department, street lights, slaughter houses, agriculture/horticulture extension services, village wood lots, strip plantation, seed distribution cases and field nurseries of Horticulture Department."

The Chief Minister said that Panchayats would prepare and implement special development plans for alleviating poverty and employment generation. "The programmes under Integrated Rural Development Programme, National Rural Employment Programme, Rural Landless Employment Guarantee Programme and Housing of Scheduled Castes and Backward Classes would be monitored by Panches and Sarpanches."

"Programmes under Indira Awas Yojna, Integrated Social Security Scheme, Integrated Child Development Scheme, Indira Gandhi National Old Age Pension scheme, National Family Benefit scheme, Indira Gandhi National Disabled Persons scheme, Indira Gandhi National Widow Pension scheme, Mahatma Gandhi National Rural Employment Guarantee Act, National Rural Livelihood Mission, Swaran Jayanti Grameen Savrozgar Yojna and Total Sanitation Campaign have to be planned and implemented by Panches and Sarpanches," he added.

Omar said identification of BPL beneficiaries for subsidized ration along with mid-day programme is also the responsibility of Panchayats."The regulation of buildings, shops and entertainment houses and checking of offensive or dangerous trades also comes under the purview of Panchayats. The construction and maintenance of slaughter houses, regulation of sale and preservation of meat and processing of skins and hides is also the job of Panches and Sarpanches," he added.

"The Panchayats are entrusted with the responsibility of regulation of sale and preservation of fish, vegetables and other articles of food. They are also expected to regulate fairs and festivals. Besides, Panches and Sarpanches would be involved in universalization of elementary education and other educational programmes," Omar said.

Replying to a question, the Chief Minister said that Panches and Sarpanches should be given some time before they adapt to the situation adding that these people are competent enough to deliver goods. "Since Panchayati Raj was not in vogue in State for more than three decades it would take some time for things to settle down."

Lauding social activist and Gandhian, Anna Hazare for his courage to speak and act against corruption, Mr Abdullah said that it was due to the resilience of Anna that steps have been taken for introduction of a strong Lokpal bill. He described the ending of fast by Anna Hazare as victory for people's power and showed the resilience of Parliamentary democracy.

"The resilience of Parliamentary system of democracy was on display as both the Lok Sabha and Rajya Sabha gave their nod for the introduction of strong Lokpal bill. It took us 42 years to get this bill introduced and credit goes to Anna for showing the way to the nation," he said.

Responding to a question about rehabilitation policy of militants who are willing to return from Pakistan occupied Kashmir (PoK), Omar said the Governments of Pakistan and PoK are acting as stumbling blocks for this policy.

"As of now we have received 900 applications from persons who wish to come back. But their return has been hampered by the establishment in Pakistan and PoK since the return of these people goes against their interests. Modalities for the return of these people are being worked out in close consultation with Government of India. The picture would become clear once this whole process is completed," he said.

On Truth and Reconciliation Commission (TRC), the Chief Minister said that it applied to various off-shoots of militancy and not alone on alleged human rights violations by security forces. "The Commission can become a reality only when the Governments of India and Pakistan agree on it."

"The TRC has to be applied on both sides of LoC and it cannot be one sided. Issues like disappearances, half-widows, people leaving the Valley and why did militancy start have to be covered under TRC. This would give a better understanding of the situation and it would lend meaning to TRC," he asserted.

The Chief Minister said that Government has framed a policy under which it would be ensured that relatives of militants are not put to any trouble. "The passports would be issued to these people. The CID wing of the police has been directed to take up the pending cases on fast track basis."

He said that his Government is waiting for the final report of State Human Rights Commission (SHRC) on the unmarked graves issue before any decision is taken. He said it would be premature to comment on the issue as of now.

The Chief Minister said the design of Kishenganga Power project has been modified and it would not affect the existence of tribes living in that area. "Hurriyat Conference is worried about the interests of Pakistan and that is the reason for them to raise cry over this project," he added.

पत्थरबाजों को ईद का तोहफा मिलेगी माफी

श्रीनगर। मुख्यमंत्री उमर अब्दुल्ला ने रविवार को पत्थरबाजों को ईद का तोहफा देते हुए उनके लिए आम माफी का एलान किया। इसका फायदा करीब 1200 युवकों को मिलेगा। उनके खिलाफ आपराधिक मामले वापस लिए जाएंगे। यह माफी उन पत्थरबाजों के लिए नहीं है, जो आगजनी और सरकारी संपत्ति को नुकसान पहुंचाने व लूटमार करने में शामिल रहे हैं। ऐसे में करीब 100 युवक माफी से वंचित रहेंगे।

श्रीनगर में पत्रकारों द्वारा यह पूछे जाने पर कि क्या यह माफी आगे भी मिलेगी, तो उमर ने कहा कि यह योजना सिर्फ रविवार यानी 28 अगस्त तक के लिए ही है। इसके बाद कोई पत्थरबाजी करता हुआ या विधि व्यवस्था को नुकसान पहुंचाते पकड़ा जाता है तो उसके खिलाफ कानून के मुताबिक कार्रवाई की जाएगी। उन्होंने कहा कि माफी वह युवक भी हासिल कर सकते हैं, जिनके खिलाफ बीते ल्ल  एक साल से विभिन्न थानों में पत्थरबाजी के मामले दर्ज हैं और आज तक फरारी की जिंदगी जी रहे हैं। ऐसे युवकों के मां-बाप अदालत से उनकी जमानत लें और इसके बाद आम माफी का लाभ देने का आग्रह करें।

मुख्यमंत्री ने कहा कि बीते साल करीब 1300 युवकों के खिलाफ पत्थरबाजी, आगजनी और लूटमार के मामले दर्ज किए गए थे। इनमें 100 के करीब युवक ही लूटमार और आगजनी में शामिल थे। उन्होंने कहा कि कई लोग दावा करते हैं कि पत्थरबाजों से राज्य की जेलें और हवालात भरे हुए हैं। लेकिन सच यह है कि सिर्फ 35 नागरिक सुरक्षा कानून(पीएसए) के तहत बंद हैं, जबकि 70 न्यायिक हिरासत में हैं। अलगाववादियों और प्रमुख विपक्षी दल पीपुल्स डेमोक्रेटिक पार्टी द्वारा गत वर्ष हुए प्रदर्शनों को शांतिपूर्ण करार दिए जाने की मुख्यमंत्री ने निंदा की। उन्होंने कहा कि इन तथाकथित अमनपसंद प्रदर्शनकारियों ने 76 सरकारी भवनों को जलाया था, जबकि 38 सरकारी इमारतों को नुकसान पहुंचाया था। पथराव करने वालों ने 16 निजी इमारतों को आग लगाने के अलावा 18 अन्य इमारतों को क्षति पहुंचाई थी। इन लोगों ने 37 सरकारी वाहनों समेत 62 वाहनों को जलाया था, जबकि 160 वाहनों को नुकसान पहुंचाया था।

घाटी के पत्थरबाजों को उमर ने दी आम माफी

श्रीनगर। जम्मू-कश्मीर के मुख्यमंत्री उमर अब्दुल्ला ने पत्थरबाजों को ईद का तोहफा देते हुए उन्हें आम माफी देने के साथ ही उनके खिलाफ दर्ज आपराधिक मामले वापस लेने का ऐलान किया है। इस कदम से उन 1200 पत्थरबाजों को फायदा मिलेगा जो गत एक वर्ष के दौरान गिरफ्तार किए गए।

मुख्यमंत्री ने यह भी स्पष्ट किया कि सरकार की माफी योजना का लाभ उन 100 लोगों को नहीं मिलेगा, जो आगजनी और सरकारी संपत्ति को नुकसान पहुंचाने व लूट मार करने में शामिल रहे हैं। उमर ने पत्रकारों को बताया गत वर्ष की अशांति के दौरान विभिन्न जिलों में हुए पथराव के आरोपों में 1200 युवाओं को गिरफ्तार किया गया था, इन सभी के खिलाफ मामले वापस ले लिए जाएंगे। यह हमारी सरकार की तरफ से युवाओं को ईद का तोहफा है। युवाओं का आपराधिक रिकॉर्ड खत्म कर उन्हें बेहतर भविष्य बनाने का मौका दिया जाएगा। पथराव के आरोपों में आज तक गिरफ्तार कोई भी व्यक्ति इस आम माफी का लाभ ले सकता है। वह भी इसका लाभ हासिल कर सकते हैं, जिनके खिलाफ पत्थरबाजी से संबधित मामले दर्ज हैं और वे आज तक फरारी की जिंदगी जी रहे हैं। उनके मां-बाप अदालत से उनकी जमानत लें और इसके बाद वह संबंधित विभाग से उन्हें भी इस आम माफी का लाभ देने का आग्रह करें। हम इस पर भी गौर करेंगे। उन्होंने कहा, आज के बाद अगर कोई पत्थरबाजी करता हुआ, विधि व्यवस्था को नुकसान पहुंचाते हुए पकड़ा जाता है तो उसके खिलाफ कानून के मुताबिक सख्त कार्रवाई की जाएगी।

अनावश्यक हस्तक्षेप

कोई भी धर्मनिरपेक्ष और सूझ-बूझ वाला व्यक्ति प्रो. कमल मित्रा के प्रस्ताव को स्वीकार नहीं कर सकता। उनका सुझाव भारत के बाल्कनीकरण के अलावा कुछ नहीं है वाशिंगटन डीसी में पाकिस्तानी एजेंट गुलाम नबी फई द्वारा प्रायोजित भारत विरोधी सेमिनारों में जवाहर लाल नेहरू यूनिवर्सिटी के प्रोफेसर कमल मित्रा चिनॉय ने भाग लेकर कश्मीर समस्या के समाधान के लिए एक नया सुझाव दिया है। चिनॉय भारत और भारतीय राजनीतिक पद्धति पर विवादास्पद विचारों के लिए जाने जाते हैं। वह माओवाद समर्थक भी हैं। चिनॉय के सुझाव का प्रभावी भाग धारा 370 का मूल रूप और नियंत्रण रेखा के एक छोर से दूसरे छोर तक कश्मीर काउंसिल का गठन समस्या का संभावित समाधान है। इस काउंसिल में सीमा के दोनों ओर के कश्मीरियों को शामिल कर प्रत्येक को उसका अधिकार देना और दोनों देशों में इसकी संप्रभुता अक्षुण्ण बनाए रखना है। इसके तहत नियंत्रण रेखा नरम होनी चाहिए। कारण, जब कभी संभव हो तो कश्मीरियों के आर-पार के लिए इसे सुलभ बनाया जा सके। 

नियंत्रण रेखा का विसैन्यीकरण होना चाहिए और पाकिस्तानी रेंजर्स व भारतीय सीमा सुरक्षा बल को यहां पेट्रोलिंग करनी चाहिए। सीमा से दस किलोमीटर दूर सेना की तैनाती होनी चाहिए। यदि किसी तरह का उल्लंघन हो तो सेना को तत्काल उपस्थित होने की अनुमति मिलनी चाहिए। उनका कहना है कि कश्मीरी काउंसिल का अधिकार विषम हो सकता है, लेकिन यह दोनों तरफ के कश्मीरियों की एकता के लिए प्रभावी कदम होगा। चिनॉय ने जोर देकर कहा है कि सभी प्रमुख सुझावों में यह सबसे अधिक कारगर प्रतीत होता है। भारतीय पक्ष को यह महसूस नहीं होना चाहिए कि वे बहुत कुछ दे रहे हैं। आखिर धारा 370 भारतीय संविधान का ही हिस्सा है। उस समय जब इसे दिया गया तो निश्चित रूप से अब भी मिल सकता है। सीमा के दोनों तरफ रहने वाले सभी शांतिप्रिय और समृद्ध लोग भारतीय, पाकिस्तानी और कश्मीरी हैं, जो अच्छे पड़ोसी के रूप में रह सकते हैं। इस संघर्ष में बहुत खून बह चुका है। यह समय शांति स्थापित करने और दोनों देशों द्वारा गलत ढंग से हथियारों की खरीदारी को प्राथमिकता न देने के लिए कारगर उपायों को ढूंढना होगा। जैसा कि हमने कुछ निश्चित सिद्धांतों पर आधारित शांति और समझौते को निर्धारित किया है, कश्मीर समस्या के समाधान के लिए सिर्फ यही मार्ग बचा है। चिनॉय राज्य में जनमत संग्रह को खारिज करते हैं। उनका कहना है कि पाकिस्तान की स्थिति और विभिन्न कश्मीरी समूहों का मानना कि संयुक्त राष्ट्र का जनमत संग्रह वास्तविकता से परे है। नेहरू ने जब जनमत संग्रह को व्यापक रूप से प्रसारित किया था, उस समय और आज की स्थिति में काफी बदलाव आ चुका है। वर्ष 1972 में पाकिस्तान और भारत के बीच शिमला समझौते में यह तय हुआ था कि कश्मीर द्विपक्षीय मामला है। 

सबसे महत्वपूर्ण यह है कि भारतीय प्रशासित कश्मीर का एक बहुत बड़ा हिस्सा पाकिस्तान के साथ विलय का पक्षधर नहीं है। इनमें से अधिकांश लोग विभिन्न तरीके से आजादी की वकालत करते हैं। ऐसी स्थिति में जनमत संग्रह से उन कश्मीरियों को कोई प्रतिनिधित्व नहीं मिलेगा जो एक अलग कश्मीर चाहते हैं। चिनॉय की टिप्पणी है कि उनके सुझाव से दक्षिण एशिया में धीरे-धीरे शांति बहाल होगी। साथ ही अलग-थलग पड़े कश्मीरियों की आहत भावनाओं पर मरहम भी लगेगा। अब समय आ गया है कि धारा 370 फिर अपनी मूल स्थिति में बहाल हो। भारतीय संविधान की धारा 370 से जम्मू-कश्मीर राज्य को बहुत अधिकार मिला था। इसके तहत राष्ट्रीय सूची में सिर्फ चार विस्तृत क्षेत्रों में आरक्षण की बात कही गई थी। इसमें सुरक्षा, विदेशी मामलों, करंसी और दूरसंचार को शामिल किया गया था। लेकिन राजनीतिक चालबाजी से सूची हल्की पड़ गई और कश्मीर को जो मूल स्वायत्तता मिली थी वह तेजी से कम होती चली गई। यदि घाटी में कश्मीरियों और केंद्र सरकार के बीच कोई समझौता होता तो जम्मू-कश्मीर को पहले की तुलना में अधिक वृहत्तर स्वायत्तता मिली होती। वास्तव में सभी केंद्रीय अधिकार, सुरक्षा, करंसी और विदेशी मामले अधिक महत्वपूर्ण हैं। उनकी राय है कि दूरसंचार जिसका सबसे अधिक निजीकरण हुआ है, कश्मीर पर नियंत्रण के लिए महत्वपूर्ण नहीं है। उनके तर्को का निष्कर्ष भारत और पाकिस्तान के बीच तनाव का मुख्य कारण कश्मीर की मौजूदा अस्थिरता है। इसके अलावा मुद्दे के समाधान के लिए केंद्र द्वारा कश्मीरियों की आकांक्षाओं के बारे में विचार न करना, पाकिस्तानी चिंताओं, कुशासन और कश्मीरियों का मानवाधिकार हनन है। इससे पता चलता है कि चिनॉय ने अन्य भारतीय ट्रैक-2 के परिचालनों की तरह दक्षिण एशिया में सभी कठिनाइयों के लिए भारत को जिम्मेदार ठहराया है। उनका मानना है कि जम्मू-कश्मीर विभाजन योजना का हिस्सा है। उनका मानना है कि पाकिस्तान और कश्मीरी मुस्लिम दो प्रमुख दावेदार हैं। कारण, उनके लंबे निबंध में जम्मू और लद्दाख का कोई उल्लेख नहीं है। 

उन्होंने सिर्फ कश्मीरियों के अलगाव के बारे में बात कही है। चिनॉय ने उन लोगों के बारे में कुछ नहीं कहा है जो वर्ष 1990 से पहले शारीरिक हमले या राष्ट्रवाद के समर्थकों के रोष से बचने के लिए घाटी छोड़ दिए थे। कोई भी धर्मनिरपेक्ष और सूझ-बूझ वाला व्यक्ति उनके इस प्रस्ताव को स्वीकार नहीं कर सकता। उनका सुझाव भारत के बाल्कनीकरण के अलावा कुछ नहीं है। जम्मू और लद्दाख को तो छोड़ ही दें, क्योंकि इसे हर किसी ने त्याग दिया है। चिनॉय की इच्छा है कि भारत, पाकिस्तान और कश्मीरियों की चिंताओं पर गौर करे और कश्मीर में भारत के खिलाफ लड़ने वालों की वित्तीय जरूरतों को पूरा करे। स्मरण रहे चिनॉय यह कहकर कि विलय की शर्ते केंद्र के क्षेत्राधिकार सुरक्षा, विदेशी मामलों, करंसी और दूरसंचार को सीमित करती है, इतिहास को तोड़-मरोड़ कर पेश करते हैं। वह जम्मू-कश्मीर और इसकी जनसांख्यिकी के बारे में अंजान हैं। यहां सिर्फ राज्य की आधी आबादी रहती है। कश्मीर की आबादी लंबवत रूप से पांच मुख्य समूहों में विभाजित है जिसमें स्वायत्तता की मांग, पाकिस्तान, स्वतंत्रता, स्वशासन और कश्मीर का दो भागों में विभाजन शामिल है ताकि वहां विस्थापित कश्मीरी हिंदुओं के लिए अलग से होमलैंड स्थापित किया जा सके। उनके लिए बेहतर होगा कि वह जम्मू-कश्मीर के मामलों में हस्तक्षेप करने से परहेज करें।

राजनीतिज्ञों द्वारा बुने मकड़जाल में रहने के लिए अशिप्त जनता

हमारे देश के अनेक बड़े राजनीतिबाजों और अंग्रेजी मीडिया के एक बड़े वर्ग के कर्णधारों की पहले सदैव यह कोशिश रही थी कि घरेलू आतंकवादियों के अस्तित्व को ही जोर-शोर से नकारते थे और हर हादसे के तुरंत बाद पाकिस्तान पर आरोप गढ़कर यह जानते थे कि उस सच को सत्यापित करने में वर्षों लग सकते हैं, अंदरूनी छिपे अपराधियों और दहशतगर्दों के पहचानने में जनता का ध्यान बंटवाते थे। आज मुंबई के 13 जुलाई, 2011 के बम-विस्फोटों के बाद की व्यथा, हताशा और सर्वसाधारण के आक्रोश के क्षणों में आम नागरिक महसूस कर रहा है कि उन राजनीतिज्ञों जैसे लालू प्रसाद यादव, मुलायम सिंह यादव आदि कुछ उन बुद्धिजीवियों की भूमिका की गहन जांच होनी चाहिए,जो सिमी जैसे संगठनों अथवा माओइस्ट कम्यूनिस्ट सेंटर या पीपुल्स वॉर ग्रुप जैसे संविधान विरोधी राजनीतिक समूहों को लंबे अरसे तक अच्छे आचरण का प्रमाण-पत्र बांटते रहते थे।

पिछले आम चुनावों में मुंह की खाए नेता रामविलास पासवान को कुख्यात अंतर्राष्ट्रीय आंतकवादी ओसाम-बिन-लादेन जैसे दिखने वाले व्यक्ति को अपनी रैलियों के मंच पर साथ खड़ाकर अल्पसंख्यकों को रिझाने की कोशिश करने वाले को आतंकवाद के प्रच्छन्न समर्थक के रूप में जांच के घेरे में लाना चाहिए। हम सब जानते हैं कि अमेरिका में चाहे सीनेट का सदस्य या बड़े से बड़ा पत्रकार ही क्यों न हो यदि वह पाकिस्तान की खुफिया एजेंसी आईएसआई या किसी भी देश विरोधी आतंकवादी का समर्थन करता है,तब स्वयं सरकार उसकी तरह में जाने के लिए एफ.बी . आई. किसी सुरक्षा एजेंसी की उपयोग करती है। वहां देश की सुरक्षा अधिक महत्वपूर्ण मानी जाती है रिपब्लिकन अथवा डेमोक्रेट की दलीय राजनीति उसके सामने कुछ नहीं है।

हमारा देश जो आतंकवाद से दशकों से पीड़ित है उसके नेता और अनेक बुद्धिजीवी अपने मानवाधिकार और उदारवादी फतवों के ऊपर मुखौटा लगाकर उनके मंतव्यों की बेझिझक वकालत करते हैं। इसीलिए उन्होंने देश की सुरक्षा व्यवस्था को पिलपिला बना दिया है। कश्मीर के मुद्दे पर वर्षों से दुष्प्रचार में लगे गुलाम नवी फई जिस तरह अमेरिका में रहकर आईएसआई के समर्थन में अमेरिका के सीनेटरों की लॉबी खड़ी कर भारत-विरोधी लॉबी बना रहे थे,यह विस्मयजनक है।

जिस तरह से अमेरिकी राजनीतिज्ञों और मीडिया की पाकिस्तानपरस्त लॉबी जो आईएसआई की धनराशि से संचालित भी उसमें आज भारत को आश्चर्य नहीं होना चाहिए क्योंकि यही काम निर्लज्ज्ता से हमारे देश में भी चल रहा है। एक खुलासे के अनुसार आईएसआई ने 40 लाख डॉलर कश्मीर मुद्दे पर वहां के राजनीतिज्ञों पर खर्च किए थे। कश्मीर के अलगाववादी नेता जब भी अमेरिका जाते थे गुलाम नबी फई ही उनके दौरे, प्रचार कार्य और सार्वजनिक छवि बनाने में करोड़ों खर्च करता था। यह सच भी सामने आया है कि अंतर्राष्ट्रीय मानवाधिकार संगठनों के इस देश के प्रतिनिधि भी उनके प्रभाव में सरकार की कश्मीर नीति व भूमिका पर प्रश्नचिन्ह लगाते रहे हैं।

इस्लामाबाद की कश्मीरी दुष्प्रचार की नीति की सफलता के पीछे नई दिल्ली की निष्क्रियता व सोए रहना ही है, कश्मीर को स्वतंत्र कराने के संघर्ष में पाकिस्तान ने जितने बार भी अंतर्राष्ट्रीय मंचों पर हमें अपमानित किया है उसका एकमात्र कारण है उसकी अक्रामकता और हमारी कायरतापूर्ण बचाव की मुद्रा। शीतयुद्ध की भू-राजनीतिक विफलता का कारण हमारा नैतिकता के उच्च-शासन पर बैठकर आदर्शवादी भाषण देना है। सच देखा जाए तो पाकिस्तान को अपने कुटिल मंतव्यों को ढ़कने की आवश्यकता कभी नहीं पड़ी क्योंकि उसका भारत का नितनूतन एवं चिर घृणा का पंचांग ही उसके आस्तित्व की बड़ी शर्त रहा है। क्या हुर्रियत या कोई पाकिस्तान समर्थक संघटन जम्मू, लद्दाख या चीन को दिए किसी भी कश्मीरी हिस्से की आवाज का प्रतिनिधित्व कर सकता है पाकिस्तान कश्मीर के हर भाग, यहां तक उसके अपने नियंत्रण वाले भाग का प्रतिनिधित्व भी नहीं कर सकता है। यह बात हमने इस मुद्दे के अंतर्राष्ट्रीयकरण करने वालों को कभी भी प्रभावी रूप से नहीं बताई। यही नहीं अपनी निष्क्रियता से हम स्वयं देशवासियों को बहुधा संशयवादी बनाते रहें।

हमारे देश में पाकिस्तान की समृद्धि व प्रगति के हिमायती या अमन की आशा जैसे कार्यक्रम चलाने वाले सामान्य जनता को एक विदूषक से लगते हैं। पाकिस्तान के जन्म से ही भारत विद्वेष और इसे नष्ट करने की कसमें खाने वालों की बात तो पुरानी हो गई। आज भी वहां क्या हो रहा है इसकी झलकियां वहां अनगिनत विचारक और राजनीतिक हमें आज भी देते हैं। कदाचित दो सप्ताह पहले की बात है जब हाल में पाकिस्तान पंजाब के गवर्नर सलमान तासीर, जिनकी हत्या कर दी गई थी, को पुत्र आतिश तासीर ने अमेरिका के प्रसिद्ध पत्र ‘वाल स्ट्रीट जर्नल’ के एक स्तंभ ‘व्हाई माई फादर हेटेड इंडिया’ लिखा था कि पाकिस्तान की भारत विरोधी विक्षिप्तता और अक्रामकता को भली भांति समझने के लिए आवश्यकता है कि यह भी स्वीकार किया जाए कि भारत जो कुछ भी है, इसकी अतीव,इसकी संस्कृति, इनकी अवधारणा उसको पाकिस्तान पूरी तरह नकारता है। वह इसलिए कि पाकिस्तान इसी पर जीवित है, नहीं तो इसका आस्तित्व ही नहीं होता।’

आतिस तासीर के अनुसार इसलिए पाकिस्तान इस्लामी अतिरेकवाद के विरुद्ध कभी खुलकर नहीं लड़ेगा। यह मात्र बुद्धिवादियों का किताबी प्रश्न नहीं है बल्कि यह इस लड़ाई में अमेरिका का सहयोगी भी कभी नहीं बनेगा, मात्र कई बिलियन डॉलरों की सहायता पर ही उसकी दृष्टि रहेगी। जहां पाकिस्तान और अफगानिस्तान में अमेरिकी प्रजातंत्र का ‘डॉलर डांस’ चल रहा है। क्षेत्रीय राजनीति में भारत की भिक्षुणियों जैस नृत्य-नाटिका ‘बेगर्स आपेरा’ हमें लगातार बचाव की मुद्रा में अभिशिप्त होंगे।

गुलाम कश्मीर जाने वाले सामान पर वैट नहीं

श्रीनगर। राज्यपाल एनएन वोहरा ने शुक्रवार को जम्मू-कश्मीर वैट अधिनियम 2005 तथा जम्मू-कश्मीर वित्तीय जिम्मेदारी व बजट प्रबंधन अधिनियम 2006 में संशोधन के लिए दो अध्यादेश जारी किए। गौरतलब है कि इस समय राज्य विधानसभा का सत्र नहीं चल रहा है, इसलिए मुख्यमंत्री उमर अब्दुल्ला के आग्रह पर राज्यपाल ने जम्मू-कश्मीर संविधान के अनुच्छेद 91 के तहत अपने विशेषाधिकार का प्रयोग करते हुए ये अध्यादेश जारी किए हैं। दोनों अध्यादेश राज्यपाल की घोषणा के साथ ही प्रभावी माने जाएंगे। जम्मू-कश्मीर वैट संशोधन अध्यादेश 2011 के प्रभावी होने से जम्मू-कश्मीर में पैदा अथवा निर्मित होने और पुंछ व उड़ी के रास्ते गुलाम कश्मीर निर्यात किए जाने वाले किसी भी सामान पर अब वैट लागू नहीं होगा। यहां यह बताना असंगत नहीं होगा क्रॉस एलओसी ट्रेड में शामिल राज्य के व्यापारी बीते कई महीनों से गुलाम कश्मीर भेजे जाने वाले सामान को वैट मुक्त करने की मांग कर रहे थे। वहीं, जम्मू-कश्मीर वित्तीय जिम्मेदारी और बजट प्रबंधन अध्यादेश 2011 के प्रभावी होने से राज्य सरकार डेबिट कंसालिडेशन एंड रिलीफ फैसलिटी (लगभग 115 करोड़ रुपये सालाना), एनएसएसएफ कर्ज के ब्याज भुगतान में छूट (लगभग 100 करोड़), केंद्रीय ऋणों की माफी (लगभग 117 करोड़) और राज्य विशेष के लिए अनुदान (लगभग 350 करोड़) जैसे वित्तीय लाभ केंद्र से प्राप्त कर सकेगी।
