Review the central laws in J&K : Interlocutors

The report submitted by the group of interlocutors  to the union Home Minister on Jammu and Kashmir has called for a review of all the central laws and articles of the Indian Constitution applicable to the state after 1952. The pro-separatist organizations sees these laws responsible for diluting the Jammu and Kashmir’s special status under Article 370, which limited the Centre’s authority in the state to the three subjects of defence, communications and the currency. The report has also proposes replacement of the word “temporary” from the heading of Article 370  with the word “Special” thereby seeking to make it permanent.

However, a review of the application of Central laws to the state after 1952, which also formed the basis for 1974 Indira-Sheikh accord, is a radical proposal with a potential to redraw the Centre-state relationship. Interlocutors also recommended the establishment of a Constitutional Committee that will look for laws that curtail the state’s special status and recommend their withdrawal after assessing powers that J&K needs “to address the political, economic, social and cultural interests and aspirations of the people in all the regions, sub-regions and communities of the state”. The Committee will take all stakeholders on board before reaching a decision. Subsequently, the President, exercising powers under clause 1 and 3 of Article 370, shall issue an order incorporating the recommendations in the Constitution. The presidential order shall then be ratified as a Bill by the state Assembly and both houses of Parliament with two-thirds majority.

The interlocutors further suggested that the state government should have a say in the appointment of the Governor, a demand of Peoples Democratic Party (PDP) in its self-rule document. The report proposes that the state government, after consulting opposition parties, shall submit a list of three names for the post of Governor to the President. Another point incorporated from the self-rule document is reduction in the number of Indian Administrative Service officers in the state and intake of more officers from the state services.

The report also makes room for Pakistan’s involvement in the process at a later stage after a consensus on a specific settlement is reached. Once the Committee’s recommendations are finalized and the separatists in the Valley also come on board, authorities in Pakistan and Pakistan Occupied Kashmir could be involved to hammer out a solution.  The panel of interlocutors led by noted journalist Dileep Padgaonkar, and including academician Radha Kumar and former Information Commissioner MM Ansari, has also stressed the right of Kashmiris to move across the Line of Control (LoC) in pursuit of socio-economic and cultural objectives and called for making the LoC “irrelevant, a mere line on a map”.Panel of interlocutors have also highlighted the problems being faced by the militancy affected people of Jammu region, demands of PoK refugees, West Pakistani refugees, discrimination with Jammu and Ladakh, migrants of Jammu region and inter district recruitment ban in the state.

‘Assembly can approve delimitation of seats’

Interlocutors find 59:41 ratio in expenditure of funds
JAMMU, Oct 10: The Interlocutors on Jammu and Kashmir, appointed by the Union Government in the aftermath of last year's summer unrest to study situation in all three regions of the State and make recommendations for a comprehensive solution to the problems faced by the people, were giving final touch to their report and would submit it to Union Home Minister P Chidambaram on October 12.

The Interlocutors-Dileep Padgaonkar, a journalist, Prof Radha Kumar, an academician and MM Ansari, a former Information Commissioner-were expected to give a unanimous report though there were reports that Mr Ansari could submit some additional documents to the Government of India, which he had been supplied in his individual capacity by some organisations especially those hailing from Jammu region.

The Interlocutors' report would be focused on political solution to Jammu and Kashmir problem while giving weightage to all other issues including Confidence Building Measures, unemployment, economic condition of people in some areas and a special mention of youth and their problems.

Ruling out restoration of pre-1953 position in the State, the Interlocutors have reportedly averred that if Parliament, J&K Assembly and all major political parties agreed on "some kind of autonomy’’ to the State as a "political solution’’ to the problem of Jammu and Kashmir, the proposal could be considered. They were in favour of granting adequate powers to all three regions of the State in the form of Regional or any other kind of Councils to end discrimination and meet regional aspirations. They have supported people-to-people contact between two parts of divided State, opening more routes, increasing frequency of buses and cross-LoC trade.

Well placed sources told the Excelsior that the Interlocutors have nearly come to the conclusion that funds approved by the Central Government to the State from time to time haven't been properly utilized. They have reportedly worked out the ratio of funds expenditure in the State at 59:41 for Kashmir and Jammu. They could suggest equal distribution of funds for two regions of the State and ‘‘adequate funding for Ladakh'' including two Autonomous Hill Development Councils for Leh and Kargil to remove a ‘‘general impression'' of discrimination in all three regions in their report.

The Interlocutors had relied on the reports of funds expenditure based on the figures obtained by them from the State's Planning Department for last 10 years as well as data submitted to them by some political parties and individuals during their interactions.

The Interlocutors, whose one year term expires on October 12, have already declared that they would submit their report on or before expiry of their tenure. They were reported to have sought appointment with both the Prime Minister and the Home Minister to submit their recommendations. They paid 12 visits to the State before finalising their recommendations in as many months.

Though one of the Interlocutors, MM Ansari had fallen apart from Mr Padgaonkar and Ms Kumar on their foreign meetings funded by the ISI agents, he joined the last meeting of the Interlocutors in the State last month and would also be joining them in submitting the report. However, he could submit some documents pertaining to use of funds in the State, separately, sources said.

The Interlocutors had reportedly came to the conclusion that demand for delimitation of Assembly constituencies in the State, raised from various quarters, was justified but it can't be met with due to a legislation passed by the State Legislature freezing fresh delimitation of Assembly seats till 2026.

They were of the view that the State Assembly had the powers to amend the legislation for delimitation of Assembly constituencies to raise their number from 87 to whatever the Legislature approved though for the purpose a two-third majority would be required in both the Houses.

The Congress (I), a major coalition partner in Chief Minister Omar Abdullah headed coalition Government in the State, though stood for delimitation of Assembly constituencies in public, has never stressed upon its coalition partner to take up the issue in the Assembly.

The NC-Congress together have a strength of nearly 45 MLAs in the Assembly. Since BJP, NPP and some other MLAs were in support of delimitation of Assembly constituencies, they could easily cobble up two-third majority in the Assembly while NC-Congress on their own have two-third majority in Legislative Council. However, since the Congress never took up the issue seriously, the NC also remained silent on the subject.

Ending regional imbalances and uniting Kashmiris by opening more cross-LoC routes, freezing restrictions on the visits and raising number of days of cross-LoC trade could be two major factors of the report. The Interlocutors would try to strike a balance between all three regions of the State while recommending ``some sort of powers'' to the State to satisfy aspirations of the people, sources said.

They added that the Interlocutors could recommend significant powers for all three regions---Jammu, Kashmir and Ladakh--- of the State. The format of powers couldn't be ascertained but the Interlocutors have ruled out restoration of pre-1953 position in the State, a major demand of National Conference and self rule, advocated by the opposition PDP. The Congress stands for 1975 Indira-Sheikh accord and BJP for abrogation of Article 370 of the Constitution, granting special status to the State. They were, however, of the view that if Parliament, State Assembly and political parties have unanimity, some kind of autonomy could be considered for the State.

The Interlocutors have virtually snubbed the BJP saying Article 370 should be kept alive. Their formula on grant of more powers to the State also lied well within the ambit of Article 370.

``There could be something significant and very important in the recommendations to satisfy aspirations of all three regions. The report is not going to be centric to any one particular region but would fulfill urges, to best possible extent, of three regions'', sources said.

They pointed out that the Interlocutors could also submit suggestions made to them by various groups including a couple of separatists they could manage to meet and formulas of both Hurriyat Conference factions headed by Syed Ali Shah Geelani and Mirwaiz Umer Farooq, Sajjad Lone, Yasin Malik and others. Without commenting upon the formulas, the Interlocutors could call for consideration of some points falling within the Constitution of India.

According to sources, the Interlocutors could also propose phased withdrawal of Armed Force Special Powers Act (AFSPA) and troops reduction in the Kashmir Valley especially in the areas, which were free of militancy and where no violence has been reported for a considerable period.

However, they were also expected to incorporate the opinion of Army garnered by them during their two prolonged meetings with Northern Command chief Lt Gen KT Parnaik including the one during their last trip to Udhampur. The Army has openly voiced its reservations over even partial or phased withdrawal of AFSPA.

The Interlocutors were likely to recommend release of political detenues, stone pelters and some other youths against whom there were no serious charges. They were expected to ask for allowing peaceful protests in the Valley and not using `force' on any kind of peaceful protesters.

Sources said the Interlocutors were of the opinion that people-to-people contact between two parts of divided Kashmir should be further strengthened by opening more cross-LoC routes in Kashmir, Ladakh and Jammu, increase frequency of cross-LoC weekly bus services and number of days of cross-LoC trade on Uri-Muzaffarabad and Poonch-Rawlakote route. They were likely to call for either freezing the permit required for cross-LoC visits or making the conditions simple to ensure that people between two parts of divided LoC could meet frequently and trade between the two sides increased. They were expected to call for providing more facilities to cross-LoC traders including opening of bank branches on either side of the LoC of two routes and doing away with the barter system of trade. They could recommend opening of all possible cross-LoC or cross-IB routes wherever possible to make the people of two sides meet frequently.

Sources said a number of demands including Scheduled Tribe (ST) status for some communities and demand of Hill Councils raised from some districts could find a mention in the report but not in the shape of recommendation. However, the demands of West Pakistan, PoK and other refugees have found favour with the Interlocutors.

They added that the Interlocutors were also likely to make a host of recommendations besides including proposals mooted by various political parties, organisations and individuals, which met them in all three regions of the State.

The Interlocutors have, however, ruled out grant of Union Territory status to Ladakh, demanded by various groups in Leh. They have reportedly called for keeping the State a single entity.

The Interlocutors visited all 22 districts of the State and received more than 600 delegations during their year long term. They held two Round Table Conference (RTCs) in Kashmir and one in Jammu. They had also planned to hold one RTC in Leh but couldn't do so due to paucity of time.

Barring a couple of separatists, no major separatist either in group or in individual met them. The separatists had even refused to submit their memoranda to the Interlocutors, which they collected on their own to incorporate some of their points in their report.

Refugee Sangarsh Morcha-Jammu Kashmir

To

    The Interlocutors,

    Ministry of Home Affairs,

    Govt.of India.

It Was terrible moment in the history When people forced to leave their homes in what now constitutes the Pakistan occupied Kashmir (PoK) in 1947 when Pakistani forces attacked Jammu & Kashmir. Subsequently, there were two more phases of movement after the 1965 and 1971 wars between India and Pakistan. Those who migrated from PoK (mainly from Muzafarabad, Poonch,Kotli, Bhimber and Mirpur areas) are yet to be settled and live even today without 'refugee' status. The government's position has been that, since they have migrated from PoK, which is legally a part of India, they are technically not qualified to be categorized under the 'refugee' bracket. Hence, they cannot claim the benefits of refugees. For the same legal reasons, recently  the Indian government has refused to pursue the compensation that is supposed to be given to those people in Mirpur, whose properties have been submerged due to the construction of the Mangla dam, funded by the World Bank.

Today, there are more than 1,200,000 people from PoK staying in and around Jammu with no political status, nor with any promise from the State and Union governments on where they stand in the Kashmir conflict. It is unfortunate that this section has been left outside the purview of both the Round Table Conferences organized by the Interlocutors on J&K. There are twelve hundred thousand wounded souls of PoK, who were subjected to genocide by the Pakistani forces in October-November 1947. This raid destroyed not only the life and property of lakhs of people but also the very fabric of human society and relationships. Thousands of innocent people were mercilessly and brutally slaughtered, property worth millions of dollars was looted and destroyed, women of all ages were kidnapped, abducted and ravished, and unspeakable atrocities were perpetrated.
Pakistani troops attacked the state of Jammu and Kashmir on October 22. This resulted in a full-scale invasion. Unfortunately, the state of Jammu and Kashmir, and the Government of India failed, which resulted in the total migration of Hindus and Sikhs from the Pakistan occupied Kashmir. This made them refugees in their own state.

The Central and the State Government of J&K set upon different schemes to rehabilitate them temporarily at different places, in houses, in shops and other available places. Refugees from Muzaffarabad desiring to settle in Kashmir valley, were not allowed to settle there. Some 300 families of Muzaffarabad who had settled in District Kupwara of Kashmir valley were uprooted again and pushed to Jammu.

In J&K, the State government has always been of the Kashmiris, by the Kashmiris and for Kashmiris. Since PoK refugees were not Kashmiris, they were not allowed to settle in the Kashmir valley. The J&K Government never wanted PoK refugees to settle in the territory. It was the central government's support that allowed some refugees to settle in the Jammu region. Many others were forced to settle in other states like Punjab, Rajasthan and UP.

Neither the Union nor the State government has been sincere in settling these refugees. There were schemes, but the administrators of these schemes have been confusing relief measures and small ex-gratia grant, with rehabilitation. These are clear instances of poor, innocent, uprooted people, being deceived by their own government.

The PoK refugees have not been compensated for their properties left behind in PoK territory in 1947. Whenever this issue is raised with the Government of India, we are told that the PoK territory will be retrieved and PoK refugees will be sent back to their places to live in their own homes. These refugees were further told that payment of compensation at this junction would jeopardize India's case at the UN.
Can we say with any stretch of imagination that government of India will ever retrieve PoK territory? Has our government enough capacity to achieve that goal? Common sense would answer these questions in "No" and "Never". The Government of India has been employing this excuse to delay this most vital issue of compensation for 60 years now. The fact remains that over a million PoK refugees are denied the right to their property. They are being grossly fooled.

Even though the Government of India talks of retrieving PoK territory, it has practically closed the case of PoK refugees as a non-issue and is going to the extent of treating the holocaust of 1947 as a non-event and PoK Refugees as non-entities.
The Government of India is also confused over the status of PoK refugees, and whether they are 'refugees', 'migrants', 'displaced persons' or 'internally displaced persons'. In whatever category the PoK refugees are placed, there are specific benefits for each category to which these people are entitled as human beings. But, we have been deprived of all such benefits. The Government of India is under an obligation to give us all such benefits.
In the resettlement and rehabilitation of PoK refugees, the J&K Government had adopted a clear policy that no refugees can settle in the Kashmir valley and if possible all PoK refugees should be pushed out of J&K State. Thus, PoK refugees have been victims twice of communal fundamentalism - first, they were uprooted from their homes and second, and they were treated most shabbily by the State Government with regard to rehabilitation, because they were non-Muslims.
The J&K Government created an authority titled Custodian of Evacuee Property to safeguard the property of Muslims who migrated to Pakistan in 1947 and were settled there permanently as citizens of Pakistan, and fully compensated them for their properties left behind in J&K State. Instead, the J&K Government should have created an authority to assess the properties in PoK. In 1982, the J&K Government passed an Act in the assembly titled Resettlement Act 1982 by virtue of which Muslims who had migrated to Pakistan, and settled there as permanent citizens, could come back and claim their properties. This was yet another blow to the process of resettlement of PoK refugees.

          Our Main Demands
1) Set up a commission to access the loses of PoK refugees in 1947.

2) Politically, PoK Refugees are orphaned, as they do not have any segment/constituency of their own, despite the fact that 24 Assembly seats are kept reserved for the PoK area in the J&K Assembly. What purpose do these reserved seats serve? We do not know. While 1/3rd of the population of PoK area is residing on this side of the Line of Control, why is it that even 1/3 of these reserved seats are not open for these refugees by creating floating constituencies or constituencies in exile? This has been done for the Kashmiri Pandits by providing them an Assembly segment of Habbakadal for which they (KPs) can cast their vote from any where in India Why has this not been done in the case of PoK Refugees?

3) Those displaced from PoK should be accorded refugee status so that they are provided all benefits under national and international laws. At the national level.

4) Representative of  PoK refugees must be included in the dialogue on J&K at every level, being a first and natural party.

5) At the technical level, an autonomous PoK Refugee's Development Board should be constituted with all financial powers and liberal aid for their upliftment and betterment.

6) The houses and  the land on which the PoK Refugees are living at present as tenants should be allotted to them permanently.

7) In PoK, the claims of moveable and immoveable property left behind in 1947 should be registered immediately. The claims of these properties should be settled at the present market rate.

8) Until the final settlement of the issue, the benefits which are provided to Valley migrants should also be given to the PoK Refugees. These include monthly cash doles, ration money, and reservation for their wards in professional and technical colleges of the country, etc.

9) Unemployed educated PoK refugee youth should be given interest-free loans to enable them to establish their businesses, and these youth should also be given reservation in government jobs. In addition, with regard to those who had their accounts at the Mirpur branch of the J&K Bank, the money lying in this bank should be paid to the account holders or to their legal heirs with interest compounded from 1947.

10) Finally, PoK refugees including those in Bhor, Chatha, Simbal, Gadigarh, Badyal Brahmana, Keerian Gandyal and Raj Bagh should be provided with all civic amenities and health services.

Centre should implement recommendations of interlocutors : Omar

SRINAGAR, 15 August : Jammu and Kashmir Chief Minister Omar Abdullah today expressed hope that Centre will implement the recommendations made by its team of interlocutors for addressing the political issues of the Kashmir problem.
“We expect the Centre not to ignore the report to be submitted by the interlocutors as has been done with several reports (on Kashmir) in the past,” Omar said in his Independence Day speech at Bakshi Stadium here. Omar said he was hopeful that the team of interlocutors headed by veteran journalist Dileep Padgaonkar—with academician Radha Kumar and former information commissioner M M Ansari as members—will submit their report soon.
“We hope that they will submit the report soon so that the issues of the state will be resolved in true sense,” he said. The Chief Minister said the dialogue was the only way to resolve disputes and issues. “I have said it many times that gun is solution to no issue. If anytime we have come closer to resolution, it was when the dialogue process was expedited,” he said.
Omar said while New Delhi and Islamabad have resumed dialogue process, the issues between Centre and state were also being addressed simultaneously. Underlining that peace and tranquillity were imperative for development, the Chief Minister said he had asked for a peaceful summer from the people to show results both on development and political fronts.
“You have contributed in this direction positively during this summer, and this government conducted successful panchayat elections in the state to empower you,” he said. Omar said the peace dividends this year had trickled down to the poor sections of the society as 5.5 lakh tourists visited Kashmir.
“The government does not earn anything from tourist arrivals as we do not tax hotels or transporters. It is people associated with tourism trade who have benefited,” he said. Omar Abdullah said the government enacted ‘Public Service Guarantee Act’ to give authority to ‘Aam Adami’ to demand delivery of public service in a stipulated time frame.
“We made general people masters of situation in this regard making administration subservient to the rights of people for prompt public service delivery,” he said. Omar said his government has also strengthened the Accountability Commission and Right to Information Act by providing heads and members to these institutions to help transparency and accountability rule the state.
On the development of power sector, the Chief Minister referred to the constitution of Chenab Valley Joint Power Venture stating that 1000 MW Pakuldul, 600 MW Kiru and 520 MW Kawar power projects are being launched by the company. He said work on 690 MW Retle, 450 MW Baghlihar-II, 240 MW Kathai-I, 990 MW Karthai-II, 1200 MW Sawalkot, 93 MW Parnai and 50 MW Kalnai power houses is underway.
“In addition, under the new hydro-power policy, 35 small power stations are being taken up in PPP mode. We are affording to generate additional 4000 MWs of power in next six to seven years,” he said. The Chief Minister appealed the people to extend their full support to his government in restoration of peace in the state so that all development and political issues would be resolved amicably. Kashmir effect All not well with interlocutors

SRINAGAR, 9 Aug. 2011 : All is not well with the central interlocutors. Having failed to hold talks with the divided separatist camp, they are themselves engaged in infighting presently. Some days back it was M M Ansari versus Dileep Padgaonkar and now it is M M Ansari versus Radha Kumar.
Ansari publicly denounced Padgaonkar for attending Dr Ghulam Nabi Fai sponsored seminar in US. Now he has criticised Radha Kumar for taking part in Abdul Majeed Tramboo’s conference in Brussels. A media report from New Delhi had stated that Radha Kumar had sent her resignation to union home ministry, which later denied the reports. Even Padgoakar during a conversation with a local news agency, KNS, denied the reports regarding the resignation of Radha and said that they would submit the final report to the Centre in first week of October.
. Meanwhile, Radha Kumar has sought to defend herself for having attended the Brussels conference. She maintained that she had traveled to Brussels in September 2006, to participate in a conference on Kashmir on the instructions of the Indian government.
Attacked for participating in the conference, which was jointly organised by James Elles (member of European Parliament) and Majeed Tramboo, who, like Ghulam Nabi Fai, operates a Kashmir Centre in Brussels, Kumar told media that that she gave the Indian point of view on the Kashmir issue. "We also met with MEA before going and, of course, our Embassy in Brussels before, during and after the conference. They all felt our participation was useful, as India had (still has) a strategic partnership with the EU and it was felt to be important for independent Indians to put their points of view in what was clearly a heavily biased forum taking place in European Parliament."
This, she said, did not go down well at all with the Pakistan lobby in the EU Kashmir Centre. The outcome report barely mentioned her remarks, she said, "When the report of the conference was sent to me in draft form, I protested that my remarks had been excised, on which a sentence was inserted."
The government, she said, also asked her at the same time, to accompany Baroness Emma Nicholson, newly-appointed rapporteur for Kashmir, on a fact-finding trip to J&K. Nicholson was, then, deputy chairperson of European Parliament's foreign relations committee and her subsequent report was the first one from the European Parliament to castigate Pakistan for cross-border terrorism.
Tramboo joined other Pakistanis in attacking the report. In one article, he said, 'On her visit to Pakistan and AJK, the rapporteur did not involve any civil society or human rights organizations there. On the contrary, during her visit to India, she engaged herself with an Indian organization which is believed to be working for and on behalf of the Indian MEA. The director of this organisation traveled with the rapporteur throughout Jammu and Kashmir and New Delhi."
Radha said, "I was warned that my name had come up in "jihadi chatter." I reported this to our government who investigated and felt the threat to me was not grave. They offered me protection which I refused feeling there was no need to strain government's resources, and not wanting my family to be worried."
Dismissing the rumours that Radha has resigned, Padgonkar said they would submit the final report to the center in first week of October.
“I talked to her (Radha) today only regarding final report as I needed some inputs from her. I won’t comment on the rumours of her resignation,” Padgonkar told KNS.
The 3-member team of interlocutors which consists of Padgonkar, Radha and M M Ansari will visit the state in the third week of August again. “We will try our best to meet separatists this time as they are the stakeholders. Where ever they want to meet us we are ready,” he told KNS.
Padgonkar said that the final report will be submitted in first week of October to the centre. He dismissed speculations of some media organizations about the report. “Nobody has seen the report yet and it is unethical and unprofessional to speculate about it,” he added.
The panel, appointed by the home ministry last year, has made 11 visits to the state so far and interacted with people in 18 out of 22 districts.
Upset over the remarks of Ansari regarding her participation in ISI sponsored conferences on Kashmir in Brussels, Radha had reportedly written to Home Minister P Chidambaram following “the smear campaign” by her colleague Ansari.
“I’m angry with Ansari’s remarks. It appears he is indulging in some smear campaign,” Radha was quoted as saying by a national news agency.

Interlocutors’ Kashmir visit in limbo

Srinagar, July 27: Mired in internal strife and controversies, New Delhi-appointed interlocutors Wednesday decided against visiting Jammu and Kashmir on July 29. And this last minute change of mind, according to sources, comes in the backdrop of several issues, including the controversy over the fact that head of the panel Dileep Padgaonkar attended an international conference organized by US-based Ghulam Nabi Fai, arrested by FBI for ‘illegally’ lobbying for Pakistan.
The panel members, including journalist Padgaonkar, academic Radha Kumar and former Information Commissioner MM Ansari, were scheduled to visit Jammu and Kashmir on July 29 to “visit four districts which they have not visited before and also hold another round-table conference on J&K issue in Jammu.”
But, according to highly placed sources, the interlocutors changed the plan at the eleventh hour “sensing that the controversy over the Fai issue, which is still afresh, might cause some degree of discomfiture to them at the moment.” Also, they disclosed, the panel members got a missive from organizers of the Round-Table Conference that “Jammu was in the midst of a controversy over the establishment of the Central University and it would therefore not be appropriate to visit the place at this point in time.”
Pertinently, the Round-Table Conference was being held in Jammu, reportedly at the Jammu University.
Sources said the interlocutors have now decided to visit the state either in the second or third week of August or immediately after Eid-ul-Fitr. “At this juncture, the interlocutors could have faced a volley of questions over the internal strife and Fai controversy. So they must have deemed it appropriate to delay the visit by few weeks so that these issues die down and they are in a much better position to do the job smoothly,” the sources said. “Also, the letter to the panel by organizers of the event would have contributed to the idea of postponement.”
When contacted, an interlocutor, wishing anonymity, said: “Yes the July 29 visit stands postponed. But I don’t think it has much to do with Fai issue. We got a letter from the organizers of the event that the visit should be postponed for certain reasons. So we did accordingly. Also, we thought that the holy month of Ramadhan is just starting and we must delay the visit by some weeks. But we are thinking of visiting the state in the third week of August.”
Pertinently the Padgaonkar-Fai link had triggered a huge controversy, with MM Ansari going on record to seek Padgaonkar’s resignation. “It is very strange and unfortunate. We need persons of impeccable integrity and character to resolve an issue as contentious as Kashmir. Was the Government of India aware about Dileep attending the conference organised by Fai before it appointed him?” Ansari told a New Delhi based newspaper recently.
The newspaper quoted Ansari as saying that while he could not speak for Padgaonkar, if he had been in the same position, he would have “quit immediately”.
Referring to Padgaonkar’s claim that he “had no idea” about Fai’s antecedents, Ansari wondered: “How can you attend a conference without knowing the credibility of the individuals and the institutions?”
But after days of controversy, the Home Minister P Chidambaram on Tuesday downplayed the issue, saying: “Frankly, it has nothing to do with his role as interlocutor. He went as a journalist some years back along with many other journalists, many other civil society members and human rights activists. Whether he should have gone or not is a separate issue. I don’t think that should be linked with his role as an interlocutor because he did not attend any meeting of Ghulam Nabi Fai after he was appointed as an interlocutor. I don’t think it’s a fair connection.”

Padgaonkar, J&K interlocutor, is among Fai’s many guest speakers

Maneesh Chhibber
A part of the funds that US-based Kashmiri separatist Ghulam Nabi Fai, who was arrested by the FBI yesterday for illegally lobbying for Pakistan and the ISI, received from his backers went into organising “international conferences” on Kashmir. Prominent among those who have attended his conferences are Dileep Padgaonkar, who is now one of the three interlocutors for J&K appointed by the Centre, former Delhi High Court Chief Justice Rajinder Sachar, former editor Kuldip Nayar and activist Gautam Navlakha.
Fai is known in India mainly for organising the annual conferences for leading political and intellectual figures, human rights activists as well as Kashmiri separatists from both sides of the Indo-Pak border and Line of Control (LoC). Most of those who attended the conclaves claim they had no idea about his covert association with the ISI. For most Indians who participated in his conferences — there have been 11 so far — they were an all-expenses paid trip to the US.
Padgaonkar said he had attended one conference organised by Fai in 2005. “It was a two-day meeting. I had no idea about his antecedents but went only after I was assured that many leading journalists from India and Pakistan would be participating. In hindsight, I agree that if I had the slightest idea about who he actually was, I would never have agreed to go to the US for his conference,” Padgaonkar told The Indian Express.
While many people who have attended his conferences refused to comment, the few who did painted a picture of a man who had access to Capitol Hill and could ensure the presence of many US politicians as well as Indians and Pakistanis. They say he spoke “very little”, always trying to avoid long conversations with his guests. “I have known him for many years now and he is a rich man. He certainly knew a lot of people on Capitol Hill and could get big names together to discuss Kashmir and Indo-Pak relations,” recalled veteran journalist Kuldip Nayar, who attended some of the conferences.
Asked if he was surprised by the timing of Fai’s arrest, Nayar said: “Yes, I am surprised. Not by the timing of his arrest but that he has been arrested. He seemed to have real clout on the Hill.” Ved Bhasin, the owner of J&K newspaper The Kashmir Times, was reportedly a regular at Fai’s events. But when contacted today, Bhasin declined to comment.
Journalist Harinder Baweja, who attended one conference, said: “He (Fai) wasn’t under investigation at that time or the US authorities wouldn’t have allowed him to hold the conference on Capitol Hill. I had gone there as a journalist and there was nothing wrong in that,” she said. Prof Kamal Mitra Chenoy, chairperson of JNU’s Centre for Comparative Politics & Political Theory, was among those invited by Fai to attend a conference.
“While I didn’t go for his conference, I met him at another meeting in PoK. I know that though he would call people of all shades, majority would have a pro-Pakistan view on Kashmir. But it is significant that he has been arrested now. It shows there is a problem between the US and Pakistan,” said Chenoy. Columnist Praful Bidwai, who attended the seventh Kashmir conference in July 2007, said he couldn’t comment on Fai as he didn’t know him personally.
Among other Indians who have participated in Fai’s conferences are academic-cum-activist Angana Chatterji, Rita Manchanda, executive director of the South Asia Forum for Human Rights (SAFHR), Prof G R Malik, head of the English department, Central University, Kashmir, and Jatinder Bakshi, president of J&K Forum for Peace and Reconciliation.
